Visa Number is just created for ASIAN people not any one else. Visa Numbers are allocated before M.L.King and not revised since then and never revised.

They are not liable to pay from the the day application was sent.
Instead, they are liable from the start date they requested on the petition OR the day you are physically in US whichever is later.
In most cases employers request immediate start dates so that the employee can start working as soon as the petition is sent (portability).

Hi folks,
My baddest of the bad phases started recently when I lost my wife's birth certificate from India. Worst part is we dont have backup (no photo copies of it).
Anyways, We are waiting in the 485 queue, working on EADs. Question to all folks, do still need birth certificate now for the green card process, as we have already sent the application?
And how bad it is with redtape/corruption in India, to get another birth certificate from my wife's birth hospital, when we try by ourselves (I mean not involving our/her parents), when we visit India next time (maybe for a month)?

Just couple of days ago immigration-law.com reported about IV and its efforts to bring relief to high skilled community and 2 days later the site gets hacked. I wonder if anti-immigrants have anything to do with it ...... they may be really scared to IV :D

I got an RFE to send copies of my degrees on nov 15th. my attorney sent the copies and my status changed to Response to request for evidence received and processing is resumed. How many days will it take for I-140 approval after the response to RFE to received by USCIS ?
It should be few days not weeks. BTW did your attorney charge money for responding to RFE?

Very legitimate question- don't know if anyone here will have a good answer (I hope so) but I hope you get your problem solved. I would advise a consultation with a good attorney, this is a very important matter for you. Some attorney's will answer an initial question free on the web- gives you some preliminary info.

Is AC21 relevant at all for NIW applicants? It can not be as there are no employers filing for such people. However is there anything related to that for such applicants?
Can't they change job or use EAD for whatever job they want to take?
Should the new job be exactly the same type of job?
If an NIW applicant loses job, will that be a problem?
When USCIS is going to know/check on what job the applicant is currently working? Is this going to happen at the I-140 approval stage or I-485 stage or when somebody applies for Citizenship?
Any NIW applicants around here in IV?

I'm a green card holder (singapore citizen) who got married while being a US PR. I wish to apply for my wife (singapore citizen) a green card.
How long is the typical wait? while applying, is it true that my wife can't enter the US?
I kind of know the answers but would like to confirm with this forum. I know the situation can be pretty bleak.

I am planning to schedule a visa appointment soon. I was filling DS-156 form
and have a following question:
Item#36 : "Has anyone ever filed an immigrant visa petition on your Behalf?".
Here is my situation:

Myself -> H1B
My wife, kid -> H4
Applied for I-485 last year ( all 3 of us ).
Question:
For me, I understand that I say "yes" and mention name of my employer.
But for my wife+kid, I say "yes", but what should I fill for "who" part?
Also, Item#33 for my kid (2nd grade), should answer to "Do you intend to study
in US" be YES or NO ? ( my guess is YES, and name of the elementary school?)

He can have both types of permanent residence pending at the same time - marriage-based and employment-based. This is very common. The marriage-based filing will probably be approved sooner than the other, because priority dates are so backlogged now.

Hi All
I got a RFE on my Substitute 140 ( PD is 2005) where they are asking for 2007 tax returns which are not filed yet, applied for extension. 2005 and 2006 tax returns are good.
Can someone suggest me what to do in this situation.
Any suggestions or any format leters...etc
