What I understand is that, your spouse can apply for H1, but not "change of status" while on EAD/adjustee. The establishment of H1 status for your spouse is possible only via an entry using H1 visa.
So your spouse can wait in USA for the H1 approval notice and then travel outside USA for consular processing.
Anyway, it may not worth all this pain, since she can continue using EAD.

Thank you, another question in relation to eb2 progressive experience. Can vacation days be counted or included in the 5 years of experience? Or does it have to be a total of 5 years of work days, and, vacation excluded? Many thanks

I understand the 180 days rule after filing 485. what if the eb3(140 approved) based 485 has been pending for 180 days, and a newly approved eb2 140 has just been ported to the pending 485.
Yes, 180 days rules applies to your 485 receipt date on your receipt notice.
Is there a rule that the 180 days started over again after porting, since it's a new 140, which implys the applicant intends to work for the 140 position for a period of time.
There is no rule that makes the "180 days" clock to restart.
What are the risks if the applicant changes the job right after eb2 140 gets approved, and changed the underlining 140 of the pending 485 from eb3 to the newly approved eb2.

I came to US on B2 10-year multiple visa, my I-94 is going to expire in a few weeks (first time extension approved ). My husband�s citizenship application has been pending for the past 10 months, it is in internal security check , so don't know how long it will take to clear.
What are the consequences if I over stay on my B1 visa for about 150 days, during which I apply for my I-130 and then go back to my home country and go for the consulor processing. Is this can be done? I got different opinions so confused. Would it impact my consular interview?
The hope is my husband�s citizenship would be approved before that and I might never have to leave the US.

one thing I found with my IXUS v3 is that the pre-flash sometimes fools you into thinking the shots done. I have not had a lot of success with P&S and moving indoor targets. Where this is an issue, I revert to some thumpers.
