Hi,
I had my last name misspelled and middle name missing on my filed perm labor application and it was filed on 12/12/2007. It was selected for audit in Feb 2008 and have not received any update until now. Can this error in my name be corrected on my application. Please advice.

There is one way to find out if CIR is any good for EB - by looking at the bill when it is proposed bill and amendments. It will be suicidal to assume that CIR is somehow bad for us, and incriminate any effort for CIR. My point earlier was not that CIR is bad for EB, but about the actual reason for Sen. Reid's recent comments, just to set the expectations straight.

Shortly after class, an economics student approaches his economics professor and says,
"I don't understand this stimulus bill. Can you explain it to me?"
The professor replied, "I don't have any time to explain it at my office, but if you come over to my house on Saturday and help me with my weekend project, I'll be glad to explain it to you." The student agreed.
At the agreed-upon time, the student showed up at the professor's house. The professor stated that the weekend project involved his backyard pool.
They both went out back to the pool, and the professor handed the student a bucket. Demonstrating with his own bucket, the professor said, "First, go over to the deep end, and fill your bucket with as much water as you can." The student did as he was instructed.
The professor then continued, "Follow me over to the shallow end, and then dump all the water from your bucket into it." The student was naturally confused, but did as he was told.
The professor then explained they were going to do this many more times, and began walking back to the deep end of the pool.
The confused student asked, "Excuse me, but why are we doing this?"
The professor matter-of-factly stated that he was trying to make the shallow end much deeper.
The student didn't think the economics professor was serious, but figured that he would find out the real story soon enough.
However, after the 6th trip between the shallow end and the deep end, the student began to become worried that his economics professor had gone mad. The student finally replied, "All we're doing is wasting valuable time and effort on unproductive pursuits. Even worse, when this process is all over, everything will be at the same level it was before, so all you'll really have accomplished is the destruction of what could have been truly productive action!"
The professor put down his bucket and replied with a smile, "Congratulations. You now understand the stimulus bill."

company A did H1B and H4 (both approval notices. No Visas stamped yet)
company B is doing H1b only. Can the dependent candidate stay on company A's sponsored H4 approval ?

I just received my EAD now. Though I am a 485 july filer, applied for EAD only in January.
My 6 th year H1 will come to end in Oct. Because 180 days since 485 filing is over, I want to use AC21 and change the Employer now, and I am thinking why to go again for H1. I have the EAD, and why not use it, though I will be joining another desi employer.
Does it seem the right thing to do? But everyine else I know changing the employer but again going for H1. Then why at all we have EAD.
I understand that if GC is rejected, and if we are on H1, we don't have to leave. But if GC is rejected, I really don't care. Even if I get the GC, I want to go to Mera Bharath Mahaan.
1. What are your thoughts on this?
2. One thing I am still not clear on is: If EAD renewal is delayed next year, and if I don't receive the approval in time (i.e. before the expiry of my current EAD) will I be out of status because no H1 and no EAD?

You must get paid by your H1B employer. Middle or another middle is not valid on the face of the law. You cannot ask any one other than your employer for pay also. If you didn't get your salary, file a complaint agaist your employer with the labor department. Do not mention about any entity other than your employer. You have no right to interfare into company matters.
Recently my employer written a mail saying that he is closing the company and said to look for new employer.Previously i am working through a middle layer.When i found new employer he directly approached main vendor regarding contract.Now i am working without middle layer.Mean while middle layer hold my 45 days pay .The middle layer is not willing to pay.It is almost 8 months.I worked more than 20 months through middle layer.Can i get my money back?The middle man Threatening saying there is contract which you cannot go and it is breach.Can you please advise.

My wife is maintaining her H4 status since Feb 07 and last entered US on H4 visa in July 2010, we have our EAD cards based on pending I485 filed in Aug 07. Her AP is valid till Jan 2011 and I am on H1B. she started working on EAD couple of weeks ago.
My question is: does the fact that she entered last on H4 affects her ability to work on EAD? Will it cause any problems in I485 approval.
Since she is working on EAD, her status is no longer H4 (the new status is AOS, so to speak). Other than that, there is no issue.

can someone pls help me with a few question on re entry permit. i will be going back to us after 1year 8months. i had applied for re entry perit in oct 2007 - i left us in may 2008 - my re entry permit is valid till july 2010. i will be going to us in feb 2010. my question is will i have problem because i left us before i got my permit. my husband who was still in us got my permit for me.

Do we get a notice to get biometrics done when you apply for EAD renewal?
My wife and I have a EAD renewal RD of June 23, 2008 at NSC. We have not gotten any LUD after that. Anybody knows how long it takes to get the EAD?

e-filed on June 8/08 FP notice on Jun/14th and FP on July 8th. No update after that.
Usually u shld get ur FP notice within 3 weeks.

Hi ,
I attended H4 VIsa intervew recently at Chennai,India and got Green 221(G) asking for some documents from petitioner. Meanwhile my husband changed the employer and got new I797.
Now at the time of submitting the documents, I understand that I need to submit new I797. But what about the documents stated in 221(G), Do I still need to submit them? If so which petitioner's documents do I need to submit? Old one or new one? As the query was mainly about petitioner and now that the petitioner is changed , do I still need to submit them?
Please advice.

I have the following situation:
1. Currently working on H1B, renewed effective Sep 15 2009 for the next 3 years (i.e. expires 2012 Sep)
2. I-485 filed in Aug 2007, PD of Jan 2006 for EB-2 / India.
3. Received and used Advance Parole in the past year or so to re-enter US (for spouse and me)
4. Have a valid EAD card that will expire October 2010. If relevant, spouse does not work, although she has an EAD card with same validity.
5. I accepted a job offer and expect to start work on Oct 5 2009 with the new company. The new job has a very similar description as the previous and is about the same level as well but higher pay.
My questions are as follows:
1. Should I request the new company to 'transfer' my H1B? What are the benefits and drawbacks of transferring the H1B as against switching to the EAD? What is the filing requirement for the transfer in terms of deadlines (i.e. do I need to have it filed on or before or within certain number of days after Oct 5?)
2. Will I be in violation of the AC-21 requirements ? What will I need to do to continue my GC process. The new employer has agreed to support the GC process and will do what is required.
3. In all this switchover, what documentation should I be requesting from my current employer's law firm? This is a big law firm and may take a few days to respond.
I need to be on point and keep pushing with the new employer as well as with the old one to make sure my legal status is not affected in the US. As such any additional tips / suggestions you have will be great too.
I have tried to provide as much detail as possible but please do let me know if I have missed anything. Again, thank you for your responses.

Washington DC has declared Sept 18 as car-free day encouraging commuters to leave car at home. For details see link below:

This suggests that on Tuesday car traffic in DC area may be less than normal, and public parking may be relatively easier to find. Normal daily parking is $12 to $16 within 1/2 mile of Washington Monument (familiar vertical landmark). Never-the-less, if possible, Metro rail is the hassle-free choice.

Hi.
I am planning to invoke AC21 via H1B.
My old employer have no issues continuing the same attorney for my future needs.
My new employer asked me to go with their attorney... but I am planning to go with my old guy who applied my 485.
Can I pay AC21, future expenses etc charges from my pocket since I am going with my old attorney.
Is it OK to me paying fees for the GC instead of Employer? Or I shud go with New company Attorney?
Appreciate your help on this.
